These Terms of Service govern access to and use of AutoRecall. AutoRecall is operated by AUTO RECALL PTY LTD, ABN 40 697 645 337 (“we”, “us”, “our”).
By accessing or using AutoRecall, you agree to these Terms.
AutoRecall is a software platform designed to help workshops and similar businesses manage customer records, vehicle records, service reminders, communications and related workflows.
You must only use AutoRecall for lawful business purposes. You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account. You must ensure that information you enter into AutoRecall is accurate and up to date.
You are responsible for all customer, vehicle and other data you upload, enter or manage through AutoRecall. You represent and warrant that:
AutoRecall may enable the sending of SMS reminders and related communications. You are solely responsible for the content of messages sent from your account, ensuring you have the lawful right to contact the recipient, handling customer opt-outs appropriately, and complying with any applicable spam, privacy or communications rules.
We are not responsible for message delivery delays, carrier issues, or actions of third-party messaging providers.
AutoRecall may be offered on a subscription basis, including with a free trial. Paid subscriptions, billing cycles, inclusions and pricing will be as displayed on the website or in the app at the time of sign-up. Unless otherwise stated, subscriptions are billed in advance, and fees already paid are non-refundable except where required by law.
We aim to keep AutoRecall available and functioning properly, but we do not guarantee uninterrupted or error-free access. You must not use AutoRecall for unlawful, misleading, abusive or fraudulent purposes, nor use it to send spam or unauthorised communications. We may suspend or terminate access if we reasonably believe there has been misuse.
We own or license the rights in AutoRecall, including the platform, branding, design, software and related materials. You retain responsibility for your own data, but you grant us the right to host, store, process and use it as necessary to provide AutoRecall.
To the maximum extent permitted by law, we exclude all warranties not expressly set out in these Terms. We are not liable for any indirect, incidental, special or consequential loss arising from the use of AutoRecall.
You agree to indemnify us against claims, losses, liabilities, costs and expenses arising from your misuse of AutoRecall, your breach of these Terms, or your use of customer data or communications sent through the platform.
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the courts of that jurisdiction.
